This website exists for one purpose: to help you explore home designs, land and indicative house-and-land information and to make an enquiry about building a home with us. It is not to be used for anything else.

Who we are
The Site is operated by Fairweather Capital Pty Ltd (ABN 88 690 917 223) trading as Your House and Land (“Your House and Land”, “we”, “us” or “our”). Your House and Land is an independent Builder Broker: we help match buyers with a builder and a block of land and present indicative package information. We are not a builder and do not carry out construction.
What this website is for
The Site is provided so that genuine prospective home buyers can research designs, land and indicative pricing and enquire about building a home through us. You may browse the Site and submit an enquiry for that purpose only. You must not use the Site, its content or any enquiry channel for any other purpose.
Acceptable use
By using the Site you agree that you will not, and will not permit anyone else to:
- use the Site, or any information or images on it, for any purpose other than a genuine enquiry about building or buying a home through Your House and Land;
- copy, reproduce, scrape, harvest, index, republish, distribute, licence, sell or otherwise commercially exploit any content, design, image, price, data or other material from the Site;
- use the Site to compete with us, to solicit our builders, developers, partners or customers, or to build, train or populate any competing service, database or dataset;
- contact, approach or attempt to deal directly with any builder, developer or supplier identified or introduced through the Site in order to bypass us;
- submit false, misleading or another person’s details, or make an enquiry you do not genuinely intend;
- use any automated system (bot, spider, scraper or similar) to access, copy or monitor the Site;
- introduce any virus, malware or harmful code, or attempt to gain unauthorised access to, interfere with, or disrupt the Site, its security or any server or network connected to it;
- use the Site in any way that breaches any law, infringes anyone’s rights, or is fraudulent or harmful.
We may monitor use of the Site and may restrict, suspend or refuse access to anyone, at any time, without notice, where we consider these terms have been or may be breached.
Information is indicative only
Everything on the Site — home designs, floor plans, images and renders, land and lot details, prices, package prices, site-cost estimates, inclusions, availability and timeframes — is general information only. It is indicative, may be incomplete, inaccurate or out of date, and can change at any time without notice. Any price or “from” price is an estimate for guidance only; it is not a quote, offer or contract and creates no obligation on us or any builder. No contract is created by using the Site
Using the Site, viewing pricing or submitting an enquiry does not create any contract, agency, partnership or obligation to build, buy or sell. Any building contract is between you and the builder you choose. If you engage us, a separate letter of engagement will set out those terms.
Intellectual property
All content on the Site — including text, layout, graphics, logos, branding, images, renders, floor plans, data and software — is owned by or licensed to Your House and Land and is protected by copyright and other laws. Builder, estate and developer materials remain the property of their respective owners. You are given a limited, personal, non-transferable licence to view the Site for the purpose described above. No other right or licence is granted. You must not copy, reproduce, modify, distribute or use any content except as expressly permitted by us in writing.
No professional advice
Information on the Site (including any “do I qualify” or finance content) is general information only and is not legal, financial, credit, tax or building advice. Finance is arranged by accredited third-party finance brokers. You should make your own enquiries and obtain your own independent professional advice before making any decision or entering any contract.
Third-party links and builders
The Site may link to or reference third-party websites, builders, developers and suppliers. We do not control and are not responsible for their content, products, services, conduct, pricing or privacy practices. Any dealing you have with a third party is at your own risk and between you and that third party.
The Site is provided “as is”
We work to keep the Site accurate and available, but we do not warrant that it will be uninterrupted, error-free, secure or free of viruses, or that any information on it is accurate, complete or current. The Site and its content are provided on an “as is” and “as available” basis. You use the Site at your own risk.
Limitation of liability
To the maximum extent permitted by law, Your House and Land, its directors, employees and agents accept no liability for any loss, damage, cost or expense (including direct, indirect, incidental or consequential loss) arising from or in connection with your use of, or reliance on, the Site or its content, your inability to access the Site, or any act or omission of any builder, developer or third party. Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant information or paying the cost of having it re-supplied.
Indemnity
You agree to indemnify and hold harmless Your House and Land, its directors, employees and agents from and against any claim, loss, liability, cost or expense arising from your use of the Site other than as permitted, your breach of these terms, or your infringement of any law or third-party right.
Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms. By using the Site and submitting an enquiry, you consent to us collecting, using and disclosing your information as set out there.
Changes to these terms
We may update these terms at any time by publishing the revised version on the Site. Changes take effect when published, and your continued use of the Site means you accept them. Please review this page from time to time.
Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia. If any part of these terms is found to be invalid or unenforceable, the remaining parts continue to apply.
